2 factors that can make a divorce more complicated

On Behalf of | Sep 18, 2024 | Divorce

Some divorces are relatively straightforward. A married couple may decide that the relationship is no longer working, so they mutually agree to end it.

However, some situations aren’t as simple as this, and several factors can make divorce much more complicated. Outlined below are two notable examples.

When the couple has children

It is rarely easy for parents to separate. In fact, many parents try to keep the marriage together purely for the children. When parents split up, it changes the entire dynamic for the children. That’s why child custody cases during divorce are often contentious.

Nonetheless, this is something that parents can get through. As long as the best interests of the child are prioritized, then the conflict can be kept to a minimum and the children can prosper post-divorce.

When the couple has a business together

Many spouses go into business together. What happens to the business if they divorce? This is a question that can greatly complicate proceedings. Typically, spouses can choose from the following options:

  • The business can be sold and both spouses receive their share of the proceeds
  • One spouse buys the other out
  • Both spouses continue running the company together as business partners

The option chosen will largely depend on the unique circumstances of each spouse.

Generally, the less conflict in a divorce, the less complicated the process. The traditional adversarial view of divorce has largely started to shift, and divorcing spouses are beginning to take advantage of more collaborative approaches. To find out the best option for you, it will help to seek legal guidance.
