What happens if you get moving violations on a provisional license or learner's permit?

First, in North Carolina, there is a three-tier graduated system for obtaining one's full driver's license. The graduation is as follows:

  1. Level 1 - Limited Learner's Permit - beginning at age 15, you can obtain a limited learner's permit. You must drive with a supervisor that is a licensed driver for 12 months without having any violations for six months preceding the possibility of moving to the next level.
  2. Level 2 - Limited Provisional License - after driving without any moving violations for six (6) months, the driver is eligible to obtain a limited provisional license. After driving (without a supervisor) for 6 more months, the driver is eligible to graduate to the next level.
    1. May drive between 5AM - 9PM without supervision.
  3. Level 3 - Full Provisional License - if no moving violations or any other violations, the driver may quality to drive without time restrictions. Before obtaining this Full Provisional License, the driver cannot have gotten any violations in the six months preceding their eligibility.

If you have your FULL PROVISIONAL LICENSE and you get two (2) moving violations you will have your driving privilege suspended. This is different than if you have a regular full license and the normal 12 point system applies before suspension.

If you, or a driver on your insurance policy is charged with a moving violation then contact an experienced traffic attorney to minimize the risk of getting a suspension on the license.
